We will never sell, or share it with any third party that we aren't required to for the services. (i.e Google, Facebook, Paypal, stripe or another payment processor for your membership security and prize pool payouts).

In order to ensure protection, fair play and respect for our members, this is our privacy policy.

By using the Services, you agree and give consent to the practices described in this Privacy Policy.

1. KEY DEFINITIONS

1.1 “Privacy Policy”
This Privacy Policy (the “Privacy Policy”) describes the type of information we collect when you use the Services. How we protect that information, how that information may be used, how you can control the disclosure of your personal information and when it may be disclosed.
1.2 “Personal Information”
Information about you as an identifiable individual that can be used on its own or with other information to contact, locate or identify you in context.

1.3 “Gaming Information”
Information about your activity using the Services, which is not personally identifiable with you, but is linked (on a non-identifiable basis) to your Account. This includes your App activity, Username, highlight footage or media materials (goal of the week, fight of the month or similar content) which may be displayed on the Website, or on other websites including Facebook.





2. INTRODUCTION

This Privacy Policy explains how we manage and safeguard Personal Information in the course of operating Cereal Gaming. We are committed to the regulations that relate to the collection, use, retention and disclosure of Personal Information.
This Privacy Policy applies to the Personal Information of all users of Cereal Gaming, including registered and unregistered visitors.
Every user has the power to get their personal data erased if they no longer want to use the Services. This includes where it is no longer necessary for the purpose it was collected. You can contact us anytime to see what information we hold, how we store it and how you can request to remove It anytime.
This Privacy Policy will remain in full force and effect with respect to your Personal Information which we retain for a limited period of time after your participation in any of the Services.
If you continue to be an in-active user for a reasonable time period, we will delete all your Personal Information on record.

We are accountable for all Personal Information in our control. This includes information under our direct control as well as Personal Information that we may transfer to third party service providers for the purposes of (i) performing support functions, such as payment processing, business analytics, data storage and destruction and (ii) marketing any of Cereal Gaming’s Services. We require any third parties that provide services on our behalf to maintain the same level of privacy protection comparable to our own.


3. INFORMATION WE COLLECT

3.1 What information is collected?

We collect two types of information when you visit the Services. Personal Information and Non-Personal Information.


(i) Non-Personal Information:

Automatic recordings of technical information related to your visit to the Services. It includes information such as the Internet domain for your Internet service provider; the Internet Protocol (IP) address of the device accessing the Services; the browser used, information about your device hardware, the date and time that you used the Services.

(ii) Personal Information.
We ask for the following information to register a Cereal Gaming account;


o Your First and Surname.
o Your date of birth, to ensure you meet age eligibility requirements.
o Where you live, to ensure that you are able to create a Cereal Gaming account based on your jurisdiction.
o Your email address. For the purpose of (i) general contact (ii) match result confirmations, (iii) Our own marketing campaigns, (iv) Feedback requests,
o Time-zone, so we can determine your local time.
o Online gaming ID, to ensure you can connect on the chosen platform with your opponent.

3.2 Proof of Eligibility
Upon registration, we will require you to provide proof of eligibility to participate in the Services, as a reasonable measure to the ensure security of the Services. Failure to provide evidence of identification and/or eligibility satisfactory to us upon request will result in the suspension and/or termination of the Account.
We may ask you for the following information. This is for the purpose of verifying your Basic Information & eligibility to use the Services.

o Valid Photo ID (i.e a copy of your driver’s license) that includes name, photograph, age and address. We delete our copy after we verify your details.

o Your username, in order to enter tournaments, send correspondence and for us to track your tournament results.

o Your communication preferences. To ensure you are able to opt out or unsubscribe from any of marketing communications.


3.3 Limits to Personal Information Collected

We limit the type of information we collect. We collect the Personal Information that is required for the purpose described in the following.


4. USE & DISCLOSURE OF INFORMATION

4.1 What do we do with your Personal Information & Why.
Use and Disclosure of Personal Information.

(i) Internal Uses.

We collect, use and disclose your Personal Information for the following purposes to which you consent to by accessing any of our Services.
o To operate the Services.
o To maintain your Account with us
o For the purpose of Friendlies, and Tournaments.
o To edit your profile
o To provide a service requested by you
o To contact you regarding updates to the Services, our new products and changes
o To process payments, membership plans and deliver tournament prizes for you
o To prevent fraud and protect the integrity of the Services
o To ensure that you comply with the Terms and are permitted to create an account based upon your jurisdiction
o Use your Personal Information to contact you regarding changes to the Terms and any other policies or agreement relevant to the Services
o Training of staff & team members.
o General administration
o Maintenance of databases

(ii) To confirm every user is eligible.

Our Services are for an 18+ mature audience. Our age verification process is intended to confirm that no user under 18 is permitted to register an Account. We do not knowingly (i) allow people under 18 years of age to create an Account, (ii) collect Personal Information from people under 18 years of age through our Services.

In the event that a visitor to our Website identifies themselves as not over the age of 18, we will not collect, store or use any Personal Information of such individual. In the event that we receive Personal Information that we discover was provided by a person under the age of 18, we will delete all such Personal Information immediately. Cereal Gaming complies with all applicable laws into online privacy and protection.

(iii) Fair Playing Environment

In order to provide a fair playing environment for all users and to protect the integrity of Cereal gaming.

We also collection Personal Information which we use to investigate cheating or behaviour that we believe may be violating the Terms, especially the Rules of Conduct. This may include screenshots of user’s screens or footage of in-game play.

In order to collect Personal Information directly from visitors to the Services, we may also collect Personal Information from third parties such as Marketing Partners to which permission has been granted to share that information with us.

(iv) Website Cookies. (“Cookies”)

Cookies are specific to the server that created them and cannot be access by other servers, which means they cannot be used to track our movements around the web.
Our Website uses two main types of cookies. (i) Per-session cookies. Used whilst you are visiting our website and are deleted when you leave. They remember you as you move between pages and help maintain security. (ii) Persistent cookies. These cookies stay on your computer until they expire or are deleted. We set automatic deletion dates so that we don’t keep your information for longer than needed.

We may collect information about your device activity for system administration and part of our audit trail process. This includes;

o Your IP address, operating system and browser type.
o To ensure your privacy when you visit our secure website.
o So that we can recognize you when you return to the Website.
o Gain insight into the nature of our audience so we can tailor our content accordingly.

5.WHO WE SHARE YOUR PERSONAL DATA WITH.

5.1 Authorized Third-Party Service Providers
We may transfer Personal Information to third-party service providers who are legally or contractually obligated to only use the information to help us provide our Services and not for any other purpose. For example, we use outside contractors for the purposes of (i) support functions such as payment processing, business analytics, google analytics, data storage and destruction and (ii) marketing any of Cereal Gaming’s services.
5.2 Marketing partners If you opt in.
To the extent that you consent, we may disclose Personal Information you provide us to third party marketing partners who provide products, information or services we may believe you may be interesting in seeing. We will ensure that these third parties only use the Personal information for our stated Purposes and that they provide an opt out from receiving future communications from such parties.
Upon registering an Account you are by default set to opt out of third party marketing. If you do wish to opt in with third marketing parties, you can tick this box on registration or contact [email protected] and request ‘subscribe to third party marketing partners’.

5.3 Legal Compliance
We are permitted by applicable laws to disclose Personal Information without providing notice of choice as required. This includes (i) when required for any legal process on behalf of any government department or agency, (ii) in an emergency to protect the safety and security of the Services or members of the public, (iii) to investigate breaches of law.
5.4 Selling shares or the company
If Cereal Gaming sells all or part of its company, or is otherwise involved in a transfer of any material part of the company, including shares. We may transfer your Personal Information to the party involved in the transaction as part of that material transfer.

5.5 Social Network sites (“SNS”)
If you follow our Facebook page, we may contact you through Facebook in regards to the Purposes. Seeing your Facebook profile in this ways means that certain Personal Information which you have provided the SNS for example, the name, email address and other Personal Information which the individual has made public, will also be seen by ourselves.


6 OBTAINING CONSENT & YOUR RIGHTS

6.1 Right to object
We collect Personal Information from an individual directly for the Purposes, as required for us to effectively and securely provide our Services. Collection of the information will be clear, and consent to the collection and use of Personal Information for those Purposes will be implied by the use of the Services.
You have the right to object to direct marketing or to request information in respect of, or correction to your personal data.

6.2 Obtaining consent
When we collect Personal Information directly from you, the Purposes are clear.
The consent to the collection and use of Personal Information is required for us to effectively provide and improve our Services. We will only add you to a marketing list once you have clearly opted in to do so.
Your Personal information will not be transferred outside of the European Economic Area.

6.3 Obtaining SNS consent for our posted social media content
You have the right to object to any of your Tournaments results being posted on our Facebook and other SNS pages. This information may include your username, tournament entry fee, result between you and your opponent, any media materials or highlights streamed for video-sharing websites or submitted to support for match evidence.
If you would like to opt out of having your username and tournament detail posted publicly in this way, then contact [email protected] requesting to ‘opt out of SNS content’.
Once requested we will ensure that we never post any details of your Username’s activity on the App. Instead you will have a generic username that is not linked to you.
The purpose for this content is to provide real world examples of completed challenges and match events.

6.4 Withdrawing consent
You may withdraw consent to the collection, use and disclosure of your Personal Information at any time by contacting Dan in our Discord, or [email protected] By doing so you will be unable to have an account or use the Services.

6.5 New purpose for Personal information

If we use Personal Information already in our possession for a purpose that was not identified at the time of collection, we will seek your consent before using this information for the new purpose.

Please note that if the new purpose if required or permitted by law, Cereal Gaming is not required to ask for your consent and will not do so.

7. ACCURACY & CHANGES TO PERSONAL INFORMATION
7.1 Updating Personal Information
Cereal Gaming is committed to open and fair privacy practices which comply with applicable privacy legislation.
We will only update personal information that is inaccurate or not up to date.
It is your responsibility to provide us current, complete, honest and accurate information and to contact [email protected] to keep the information up to date.
We may request any incomplete information that is required for the Purposes from you at any time.

7.2 In-accurate Personal Information liability
Cereal Gaming will not be responsible for any liability that may arise if a user does not provide us with current, complete, honest and accurate Personal information or if the user fails to update such information.

8.MAINTENANCE OF YOUR PERSONAL DATA

8.1 Management of Personal Information

We have policies and procedures as to how long we retain collected information.

Personal Information that is no longer required to fulfil the Purposes is destroyed to prevent unauthorized parties from gaining access to the information.

We retain Personal Information received from third parties in accordance with our legal and contractual obligations. The file containing your Personal Information will be made available to the authorized team members, contracts or agents of Cereal Gaming who need access to the information in connection with the Purposes and will be held primarily in a secure electronic database. These databases may be located in Wales, United States or elsewhere in the world.

Personal Information included in computer databases is stored in a secure data centre with an extra copy of the data stored at an alternate location of equal security to ensure that we are able to retrieve the data in the event of a disaster.
We may transfer Personal Information stored in these databases (as otherwise permitted under this Privacy Policy) to third-party service providers. This may include data storage companies, security specialists, technicians who may have remote access to Personal Information in our custody for the purposes described.
We use safeguards to ensure that Personal Information transferred to such parties has a comparable level of protection as Cereal Gaming provides. All Personal Information is encrypted with the latest SSL certificates.




9. GENERAL APPLICATION OF OUR PRIVACY POLICY

This Privacy Policy only covers personal information collected by Cereal Gaming and we are not responsible for any data the users pass to other third parties.

9.1 SECURITY SAFEGUARDS AND LIABILITY
Cereal Gaming Ltd has implemented commercially responsible security safeguards to protect Personal Information in our control against loss, theft, misuse and interception by third parties.
These safeguards include (i) premise access security, (ii) restricted file access to Personal Information, (iii) technology safeguards, including security software & firewalls to prevent hacking, (iiii) internal password and security policies.
Please note that no data transmission or storage can be guaranteed to be 100% secure.
We are committed to protecting your Personal Information but we cannot warranty the security of any information you give to us.

9.2 Unauthorized Use
You are responsible for maintaining the confidentiality of your pin-code and account, and you are fully responsible for all activities that occur under your Account.
Please take reasonable steps to guard against identity theft.
In the event of unauthorized use of your Account or any other breach of security, you must notify [email protected] immediately and promptly change your pin code with support.



10. DATA PROTECTION COMPLIANCE

10.1 Data Compliance Officer
All members of the team are responsible for the security and use of Personal Information. Our designated Data Compliance Officer (“DCO”) helps Cereal Gaming maintain our data protection compliance.
They are the internal authority on data protection guidance for all activities involving personal data, this includes compliance with General Data Protection Regulations (“GDPR”).
You may request access to your Personal Information held at any time.

Our Data Compliance Officer must report destruction, loss, alteration, unauthorised disclosure of, or access to people’s data to the data protection regulator, ICO. The ICO has to be told about a breach 72 hours after discovered as well as the people impacted. They are obligated to maintain a written record of processing activities carried out on behalf of Cereal Gaming Ltd as well as regular Privacy Impact Assessments.




10.2 Access to your information.

Message us anytime if you would like to receive the information being held about you.
After receiving the request, our Data Compliance Officer will inform you of the existence, use and disclosure of all your Personal Information.
You will receive all Personal Information we hold within a maximum of one month after your written request.
Upon request from you to have your Personal Information destroyed. Cereal Gaming will destroy such information to the extent that retention of such information is not required or permitted by applicable law, such as for the investigation of claims or the defence of an action. Some Personal Information may remain in storage for this purpose.

If we modify this Privacy Policy, we will update the “effective Date” and such changes will be effective upon posting to this website to the extent that such changes do not require that we first obtain your consent.



12. GOVERNANCE
Cereal Gaming Ltd is governed by and operated in accordance with the laws of England & Wales.
You hereby consent to the exclusive jurisdiction of and venue in the courts of England and Wales, in all disputes arising out of or relating to the Services. Notwithstanding any other provisions of this Privacy Policy or the Terms.
You agree that any dispute that cannot be resolved between the parties shall be resolved individually, without resort to any form of class action.
Cereal Gaming makes no representation that the Services are operated in accordance with the laws or regulations of, or governed by, other nations.
By using the Services and participating in any activity, you certify that you meet the eligibility requirements for the Services set forth in the Terms.
If you do not meet the eligibility requirements, please discontinue using the Services immediately, as your continued use of the Services indicated that you are agreeing to the collection, use, disclosure, management and storage of your Personal Information as described in this Privacy Policy.
